Thank you for choosing Via Rosa Experiences. We are honored to be part of your travel journey. Please read the following Booking Terms & Conditions carefully, as they govern all reservations made through Via Rosa Experiences.
By submitting a reservation request, authorizing payment, or traveling on one of our Hosted Experiences, you acknowledge that you have read, understand, and agree to these Terms & Conditions.
About Via Rosa Experiences
Via Rosa Experiences, LLC is an independent travel advisor and hosted group travel company.
We act solely as an agent for travel suppliers including, but not limited to, cruise lines, airlines, hotels, tour operators, transportation providers, excursion companies, and travel insurance providers.
Via Rosa Experiences does not own, operate, or control any airline, cruise ship, hotel, motorcoach, excursion, or other travel service.
All travel services are provided solely by the applicable supplier and are subject to that supplier's terms and conditions.
Reservation Requests
Submitting a reservation request does not guarantee space on a Hosted Experience.
Reservations are accepted on a first-come, first-served basis and are subject to supplier availability.
Your reservation is not confirmed until:
The required deposit has been successfully processed with the travel supplier.
The supplier has confirmed your reservation.
You have received confirmation from Via Rosa Experiences.
Pricing
All pricing is subject to availability until your reservation has been confirmed.
Cruise fares, tour prices, promotions, taxes, port fees, and supplier pricing are subject to change without notice until booked.
Once your reservation has been confirmed, future pricing changes generally will not affect your reservation unless required by the travel supplier.
Deposits & Payments
Deposit amounts and payment schedules vary by supplier and Hosted Experience.
Payment deadlines are established by the travel supplier.
Failure to make payments by the supplier's due dates may result in cancellation of your reservation and the loss of deposits or payments already made.
Via Rosa Experiences is not responsible for penalties resulting from missed payment deadlines.
Credit Card Authorization
By providing your credit card information and authorizing payment, you authorize Via Rosa Experiences to process payments directly with the travel supplier on your behalf.
Via Rosa Experiences does not process or retain payment for travel services unless specifically stated.
All charges are processed by the applicable travel supplier.
Cancellations & Refunds
Cancellation policies vary by supplier.
Any cancellation penalties, administrative fees, or non-refundable deposits are determined solely by the travel supplier.
Refund eligibility is governed entirely by the supplier's cancellation policy.
Via Rosa Experiences cannot waive, reduce, or override supplier penalties.
Travel Protection
Travel protection is strongly recommended for every traveler.
Travel protection may provide coverage for trip cancellation, trip interruption, medical emergencies, lost baggage, travel delays, and other unforeseen events.
If you decline travel protection, you acknowledge that you understand the financial risks associated with traveling without coverage.
Passports, Visas & Travel Documents
It is the traveler's responsibility to obtain and maintain all required travel documentation.
This includes but is not limited to:
Valid passport
Required visas
Entry permits
Vaccination requirements
Government travel documentation
Many countries require passports to remain valid for at least six months beyond the date of return.
No refunds will be provided for denied boarding or denied entry due to improper documentation.
Health & Accessibility
Travelers are responsible for determining whether they are physically able to participate in the activities included with their Hosted Experience.
Accessibility needs, dietary restrictions, and medical concerns should be communicated as early as possible.
While Via Rosa Experiences will gladly communicate these requests to suppliers, accommodations cannot be guaranteed.
Itinerary Changes
Travel suppliers reserve the right to modify itineraries due to:
Weather
Mechanical issues
Government regulations
Safety concerns
Operational requirements
Events beyond their control
Such changes do not constitute grounds for refunds unless specifically provided by the supplier.
Hosted Experiences
Hosted Experiences are designed to create enjoyable group travel experiences while allowing travelers the freedom to enjoy their vacation.
Although Maria Capeles serves as the host for these experiences, all transportation, accommodations, excursions, and travel services are provided by independent travel suppliers.
Travelers are expected to treat fellow guests, suppliers, and local communities with courtesy and respect.
Via Rosa Experiences reserves the right to refuse or terminate participation if a traveler's conduct creates a safety concern or significantly disrupts the group experience, subject to the applicable supplier's policies.
Photography & Social Media
During Hosted Experiences, photographs and videos may be taken.
Unless you notify Via Rosa Experiences in writing prior to departure, you grant permission for photographs or videos in which you appear to be used for marketing, promotional materials, social media, and future Hosted Experience advertising.
No compensation will be provided for such use.
Supplier Responsibility
Via Rosa Experiences is not responsible for the acts, omissions, financial condition, negligence, or performance of any travel supplier.
This includes, but is not limited to:
Airlines
Cruise lines
Hotels
Tour operators
Transportation companies
Excursion providers
Travel insurance providers
Any claims relating to travel services must be addressed directly with the applicable supplier.
Limitation of Liability
Via Rosa Experiences shall not be liable for any injury, loss, damage, delay, inconvenience, additional expense, illness, death, or property damage arising from:
Supplier actions or omissions
Weather
Natural disasters
Acts of God
Government actions
Labor disputes
Airline delays or cancellations
Mechanical failures
Civil unrest
Epidemics or pandemics
Theft
Lost luggage
Any event beyond our reasonable control
Communication
Most communication regarding your reservation will be sent via email.
It is the traveler's responsibility to monitor their email and respond to requests for information or payment in a timely manner.
Via Rosa Experiences is not responsible for missed deadlines resulting from unread emails or spam filtering.
Privacy
Personal information collected during the reservation process is used solely for arranging travel and communicating with travelers regarding their reservations.
Information is shared only with travel suppliers and service providers as necessary to complete your reservation.
Via Rosa Experiences does not sell your personal information.
Governing Law
These Terms & Conditions shall be governed by the laws of the State of Georgia.
Any disputes arising from these Terms & Conditions shall be resolved in the appropriate courts located within the State of Georgia.
Acceptance
By submitting a reservation request, providing payment authorization, or participating in a Hosted Experience, you acknowledge that you have read, understand, and agree to these Booking Terms & Conditions.
